Terms of Service

Product: Family Harmony ("the Service") Provider: NunezDev LLC ("we," "us," "our") Effective date: July 28, 2026

1. Agreement to these Terms

By creating an account or using the Service, you agree to these Terms of Service ("Terms") and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of your household, you accept these Terms for your household.

2. Eligibility and family use

• You must be at least 18 years old and the parent or legal guardian of any child whose information you add.
• The Service is a parent‑managed family tool. Only the adult account holder may create the account and add or edit family‑member profiles. You are responsible for supervising your family's use, including any use by children on your household's devices, and for all activity under your account.
• You represent that you are authorized to provide any information you enter, including a child's name or photo, and that doing so does not violate anyone's rights.

3. Accounts and security

You are responsible for keeping your login credentials and parental PIN confidential and for all activity under your account. Notify us promptly at privacy@familyharmony.co of any unauthorized use. We are not liable for losses caused by unauthorized use of your account.

4. Subscriptions, billing, and cancellation

(Applies once paid plans are offered.)

• Certain features may require a paid subscription. Prices, billing intervals, and any free‑trial terms are shown at purchase.
• Subscriptions auto‑renew each billing period until cancelled. You authorize us and our payment processor to charge your payment method on each renewal.
• You may cancel anytime; cancellation takes effect at the end of the current paid period. Except where required by law, payments are non‑refundable and we do not provide partial‑period refunds.
• We may change prices with prior notice; changes apply to the next renewal.

5. License and acceptable use

We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for your household's personal, non‑commercial use. You agree not to:

• resell, sublicense, or use the Service to build a competing product;
• reverse engineer, scrape, or attempt to breach security or access another household's data;
• upload unlawful, infringing, or harmful content, or others' personal information without authorization;
• use the Service to violate any law or third‑party right, or to disrupt or overload the Service.

6. Your content

You retain ownership of the content you add (events, photos, notes, etc.). You grant us a limited license to host, process, display, and back up that content solely to operate the Service for you and as described in the Privacy Policy (including the optional AI features you choose to use). You are responsible for your content and for having the rights to submit it.

7. Third‑party services

The Service integrates optional third‑party services (e.g., Google Calendar, Google Photos) at your election and sends data to service providers to function (see the Privacy Policy). Your use of those third parties is governed by their own terms and policies. We are not responsible for third‑party services.

8. Availability, changes, and beta features

We may modify, suspend, or discontinue features at any time. We aim for high availability but do not guarantee the Service will be uninterrupted or error‑free. Some features may be offered as beta and provided "as is."

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that reminders, notifications, or calendar sync will always be timely or delivered, and you should not rely on the Service for time‑ or safety‑critical matters.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NunezDev LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnification

You agree to indemnify and hold harmless NunezDev LLC from claims arising out of your content, your use of the Service, or your breach of these Terms, except to the extent caused by us.

12. Termination

You may stop using the Service and delete your account at any time (Settings → Delete account). We may suspend or terminate access for violation of these Terms or to protect the Service or its users. Sections that by their nature should survive termination (e.g., 6–11, 13–14) survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict‑of‑laws rules.

14. Changes to these Terms

We may update these Terms. If changes are material, we will provide reasonable notice (e.g., in‑app or by email). Continued use after changes take effect means you accept the updated Terms.
